Default GPU fan not working

Yeah, like it says.
its an eVGA 8800GTS 320
I turned fan speed to 100% on rivatuner, but nothing
Brand new card, so it hasn't got dusty or anything.
I might take it out and have a closer look.

yeah, so is it an RMA, or could there be something like: its not getting power properly?

Could I fix it?

It sits at 70C idle. urg.

How long does an RMA take?
