Default Speeding Ticket

so tonight i get my second traffic ticket... haven't even gotten to the court date to defer my first ticket :-(

so anywho anyone know some things about driving laws / ways to keep the ticket(s) from hitting my insurance?

i've checked out some things like the "overpaying" thing which is fake, but i have a friend who has gotten 8 tickets and gotten out of all of them by selecting mitigation (plead not guilty asking to explain the circumstances and stuff), but mail in a check with it, the court is confused thinking you made a mistake and just assumes you pay it, then if you aren't given a court date within 30 days you were "neglected" and the case dismissed... just curious if anyone knows something similar / helpful

Usually on the first offense you can get it reduced or get traffic school or something. The second one, being so close to the first, will cost you. Unless you hire a snake of a lawyer to get you out.

a lot of times you will have to go to some type of driving school to get it reduced or wiped off your record. Generally though its a one time thing so the second will probably affect your insurance.

what state are you in??? that makes a big difference

in florida, you can take a driving course which will reduce the fine and keep the points off your license. but you can only do this once a year and 5 times in your lifetime.

the other option would be to goto court and plead "adjudication withheld" which means you're not admitting to the crime, but not denying it. if the ticket-issuing officer is ok with that, the judge will be ok with it and you'll have to pay the fine but will have no points assessed.

whatever you do, DO NOT try to "cheat" or "trick" the system. it won't work, and you'll likely end up in deeper s**t than you were before

i figured you could check my prof but im in washington - i was gonna contest the first for sure cause i was going up hill, new at driving, and hit the gas a little hard and they were at the crest of the hill... also i just took my car in to get serviced and they said the speedometer was actually off about 4 mph (asked them to check) so that shouldn't be a problem...

i know trying to "trick the system" probly would **** me over but my friend insists his method works.... i figure i'll contest both in writing and hope the officer can't retalliate in time or something

so i'm also moving to arizona, if i dont sort it out in time here (next court date is in october or something when i'll be out of washington do they carry over? I would imagine they do but otherwise it'd be pretty easy to dodge a ticket just by leaving the state..... i hear court is a ***** though

ticket 1 was speeding - 37 in a 25 zone (ticket written for 35 in a 25 zone though)... argument would be something like how it was on top of a hill, i was unexperienced at driving blah blah as well as my speedometer was broken

ticket 2 was breaking an intermidiate license law (out past curfew) - they cant pull you over for it but this guy did. my argument would be something along the lines of how he had no reason to pull me over but i'll check things to make sure that would hold up. Also he made a few mistakes and said he saw me going the other way on the street and that i was speeding so thats why he followed me - might have something to do with the speedometer mistake too because i was going exactly 35mph

suggestions / comments?

im pretty sure they are going to take your license away for like a month
unless you contest them and win but thats not that easy well not around here anyway

and he can pull you over for whatever they want all he has to say is you looked suspicious, and if you use the whole speedometer broke for both it wont work because you are spoused to get that fixed ASAP

i doubt youll get out of either man, sorry but you knw the rules and now you'll know the consequences

first of all, 4 mph difference from speedo would still put you at 33 in a 25 which is still speeding.

second, you CANNOT go in there and give them a reason WHY you were speeding...ESPECIALLY not a reason like "i'm unexperienced". if you give excuses, then you're admitting to the crime.

the court doesnt care why you were speeding, just like they dont care why so-and-so murdered his wife. the law was broken, period.

this would require a lot of doing to prove (because he didnt write you a ticket for speeding, so its not documented) and only would MAYBE get you out of it. the fact is, however, you were still out past curfew and unless you can prove, without a doubt, that the cop had no right to pull you over, you won't get out of it. i'll wager my entire savings account that you can't. it's the cop's word against yours.

i'll say good luck just in case you do try to fight this, but i would just recommend taking a driving class for one and asking for adjudication withheld for the other. if you do this successfully, you won't get the points on your license.

If you challenge the first ticket you'll lose the oppurtunity of traffic school in most states.

And they won't give a **** that the cop pulled you over illiegitimately...he can just says "looked like he was swerving..." no way to prove, 100% legitimate.

The trick to getting a ticket dismissed lies in finding something they can't prove on the ticket. Personally, I'd forget about it unless you hire a lawyer.
