It depends. If you found a penny on the ground in a parking lot or something, then that's ok.

But if you found a piece of merchandise on the shelf in a store, then that is not ok

Perhaps giving us some crucial info, like where you found said item, and what said item is....

if you take something w/o permission, it is considered stealing.

i found a cell phone outside the dentistry in between the dentist building and the shop next to it.
its a motorola razr v3 verizon phone brand new still had full battery.

but i want to keep it to activate myself. but heard that you cant activate razr phones if its not yours because of some serial number

If you think that the person who lost it would be upset over losing it then you should return it. But that is a moral interpretation not a legal one.

I would definately try to return a cell phone.

yea exactly once the other guy has reported that his phone is stolen then youll get in trouble if you try to activate it. best thing i think you could do if you wanna be mean is if someone else has that same phone ask them to borrow it then quickly swap it with that one and just smash the **** out of it in front of them...
