Default iPod Battery=dead, returned iPod=used??

I read a while ago that when you ship your iPod in for a new battery, Apple sends you back a used iPod. Is this true?

"If a defect exists, at its option Apple will (1) repair the product at no charge, using new or refurbished replacement parts, (2) exchange the product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original product, or (3) refund the purchase price of the product."

I would say it's true. do not send in your ipod, ask if you can just send in the battery only. this happens all the time with defective computer parts like mobos. FYI refurb is just as bad as used parts, actually sometimes worse...than again sometimes a refurb part is as good as new, on accident of course

Actually Apple guarentees that their refurb and used parts are functioning and in the same working order as their new parts. With battery issues, Apple just replaces the battery with a new one. No big deal. They also clean your ipod free of charge.
