Until your DHCP server is back up set yourself a static IP address. Just ensure that it is valid on your network and fits the correct subnet. Your linux machine probably has a static IP address, therefore you can run ifconfig (requres root) on your linux machin to get the details you need, such as subnet mask that you will need for your windows machine

i called the technical support and the guy said modem records the mac address of the ethernet card and it has different values in linux and windows, so when booted linux it recorded the new mac but i couldnt record the one in windows again... thats his explanation... so i have to cut the power off for 30secs to reset it... not logical though

The MAC is specific to the card and should be the same when using the same card, whatever operating system you use and whatever computer it is in! Perhaps you had one OS set to use a different MAC for the card somewhere along the line. I take it all is well now then?

thats exactly why it didnt sound logical to me coz i couldnt have used two different cards even if i wanted to coz there is only one cable and one modem well now i connected it to my intel card and both OS work fine...
