i made a back of the original but it keeps crashing when i use the backup. Do i need a patch?

I imagine. Go to the manufacturers website and look for the patches section. If that fails you might want to make a new copy of the game. If that fails then the game may be copy protected.

maybe there is something in the CD that is attached to it that it doesnt burn and it cant work without that file!

dude use clone cd to burn a new copy of the game. Clone cd burns an exact copy of the game. It does such a good job that you don't even need a no cd patch to use the cd burned with clone cd.
